This Privacy Policy describes how Rogie Development processes and protects personal data collected through the "Lode" landing page (the "Site") and the "Lode" software (the "Product").

1. Data Controller

2. Personal Data, Purposes, and Legal Basis

We process your personal data in accordance with the General Data Protection Regulation (GDPR) and the Dutch Uitvoeringswet Algemene verordening gegevensbescherming (UAVG).

Data Category Purpose of Processing
Email Address To send you product updates and notifications regarding Lode, for which you have subscribed.
IP Address To log form submissions on our Site for security, spam prevention, and abuse detection.
Anonymous Usage Data (Site) To analyze website traffic and improve the user experience.
Unique Installation ID & Product Usage Data (e.g., features used, clicks, performance metrics) To analyze how the Product is used, identify popular/unpopular features, find bugs, and improve the Product's functionality and user experience.
Product Version & Platform/OS To automatically check for new software updates and provide them to you.

3. Data Processors (Third Parties)

We use third-party services ("Data Processors") to provide our service. These processors are contractually obligated to protect your data.

  • Cloudflare, Inc.: Provides website hosting, security, and data storage.
  • PostHog, Inc.: Provides cookieless, anonymous website analytics. PostHog is also used to process Product Usage Data (as defined in Section 2) for the Product.
  • MailerLite: Will be used to manage and send email communications.

4. International Data Transfers

Some of our data processors (such as Cloudflare and PostHog) are based outside the European Economic Area (EEA). We ensure that any transfer of your personal data is lawful and secure by relying on an Adequacy Decision from the European Commission or by implementing Standard Contractual Clauses (SCCs).

5. Data Retention

We adhere to the principle of storage limitation:

  • Email Address: We retain your email address until you withdraw your consent (unsubscribe).
  • IP Address: We retain security logs containing your IP address until we confirmed that your email was not submitted by a spambot.
  • Anonymous Usage Data (Site): This data is anonymized and may be retained indefinitely for statistical purposes.
  • Product Usage Data: This data is processed as long as you use the Product and consent to tracking (where applicable). Anonymized, aggregated usage data may be retained indefinitely for statistical purposes.
  • Update Check Data: This data (version, platform) is processed at the time of the update check and is not stored long-term in a way that is linked to a specific user.

6. Your Data Protection Rights

You have the following rights regarding your personal data:

  • Right of Access: You may request a copy of the personal data we hold about you.
  • Right to Rectification: You may request correction of inaccurate or incomplete data.
  • Right to Erasure (Right to be Forgotten): You may request the deletion of your personal data.
  • Right to Restrict Processing: You may request that we limit the processing of your data.
  • Right to Object: Where we process your data based on Legitimate Interest (e.g., update checks), you have the right to object. However, as this processing is essential for the Product's security and function, objecting may require you to stop using the Product.

7. Product Data & Consent

This section details your rights regarding data collected by the Product and by our newsletter.

A. Product Analytics (Non-Beta Versions)

For non-beta versions of the Product, your Consent is the legal basis for processing usage data. You can withdraw this consent at any time by navigating to the settings within the Product and disabling "Usage Tracking" (or a similarly named option).

B. Product Analytics (Beta Versions)

For beta versions, tracking is mandatory and a condition of use (Performance of Contract). You cannot opt-out. If you do not wish your usage data to be tracked, you must uninstall and stop using the beta version.

C. Newsletter (Unsubscribing)

You have the right to withdraw your consent for email communications at any time. You can do this via two methods:

  1. Clicking the "Unsubscribe" link provided in every email you receive.
  2. Sending an email to lode@rogiedevelopment.nl with the specific subject line 'Unsubscribe Lode newsletter'.

Your data will be removed from our mailing list within 72 hours.
