1. Acceptance of Terms
By accessing and using this website ("Site") and/or downloading, installing, or using the "Lode" software product (the "Product"), you accept and agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use this Site or the Product.
2. License to Use
Subject to these Terms, Rogie Development grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Product for your personal or internal business purposes.
3. Intellectual Property
All content on this Site, and all software, code, and intellectual property comprising the Product, including but not limited to text, graphics, logos, and the "Lode" trademark, is the exclusive property of Rogie Development. You are prohibited from copying, distributing, modifying, reverse-engineering, or using any content or the Product without our express written permission.
4. Security Risks & Acknowledgement
You explicitly acknowledge and agree to the following:
- A. Administrative Privileges: To function, the Product requires installation with administrative (admin/root) privileges on your computer.
- B. Trusted Certificate Authority (CA): The Product will install a trusted root Certificate Authority (CA) on your device. This is necessary for the Product to perform its intended functions.
- C. Inherent Risk: You understand that a tool with admin privileges and a trusted CA could theoretically be exploited by malicious third-party software ("hackers") to monitor, intercept, or modify your local network traffic (a "Man-in-the-Middle" or "MITM" attack).
- D. Assumption of Risk: While Rogie Development has taken security measures to mitigate these risks, you accept and assume all risks associated with installing and using the Product, including the risk of unauthorized access or exploitation by third parties.
5. Disclaimer of Warranty
The Site and the Product are provided "as is" and "as available" without any warranties of any kind. Rogie Development does not warrant that the Site or Product will be error-free, that the Product will be released, or that the final Product will meet your specific requirements.
To the fullest extent permitted by law, Rogie Development disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We explicitly disclaim any warranty that the Product is secure, free from vulnerabilities, or impenetrable to attack.
6. Limitation of Liability
In no event shall Rogie Development be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of, or inability to use, this Site or the Product.
This includes, but is not limited to, any damages, data loss, privacy breaches, or security incidents resulting from the Product's use of admin privileges, its installation of a trusted CA, or any potential misuse, vulnerability, or exploitation of the Product by third parties (including MITM attacks).
7. Indemnification
You agree to indemnify, defend, and hold harmless Rogie Development from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising from or in any way related to your access to or use of the Product, your violation of these Terms, or any security breach or data interception that occurs on your system.
8. Data Collection and Automatic Updates
Your use of the Product is subject to our Privacy Policy, which details how we collect and use data. You acknowledge and agree to the following:
- A. Automatic Updates: The Product automatically checks for updates on each startup. This process sends a request to our servers containing the Product's current version and your platform (Operating System). This feature is essential for security and functionality and cannot be disabled.
- B. Usage Analytics: The Product integrates PostHog analytics, which tracks usage via a unique installation ID to help us improve features and identify bugs.
- Beta Versions: If you are using a beta version of the Product, this tracking is mandatory and cannot be disabled. If you do not agree to this tracking, you must not use the beta version.
- Non-Beta Versions: If you are using a stable, non-beta version, you will have the option to opt-out of this tracking within the Product's settings.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the Netherlands.
10. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision.
11. Changes to Terms
We reserve the right to modify these Terms at any time. All changes will be effective immediately upon posting to the Site, and your continued use of the Site and/or Product will constitute acceptance of such changes.
